US District Court , WDNY Dismisses Consumer Debt Case for Daniel R. Ryan, Esq.
Representing the defendants in a consumer debt case in the US District Court for the Western District of New York, Daniel R. Ryan, Esq., moved to dismiss plaintiff's action. The plaintiff alleged the defendants commenced the state lawsuit after the applicable statute of limitations expired and contended New Hampshire law would have controlled and set the statute of limitations at three years, making the suit untimely. The Court concluded however that the case was an attempt to relitigate a claim whose resolution in state court deserved full faith and credit from the Court. Because plaintiff had no claims left that did not hinge on the statute of limitations, the Court dismissed the action.Back
